TERMS OF SERVICE

Clear terms for using Bluebird Compliance.

Effective October 26, 2026 · Version 2026-10-26.2

Bluebird Compliance is operated by TerraGuard Environmental, LLC.

Bluebird Compliance supports inspections and follow-up. You remain responsible for the facility information, observations, and decisions recorded in your account. These terms include warranty disclaimers and limits on liability; please read them before accepting.

1. Who these terms cover

These Terms of Service govern access to Bluebird Compliance and its related website, provided by TerraGuard Environmental, LLC, which operates the Bluebird Compliance product ("we" or "us"). By affirmatively accepting these terms, you agree to them for your use of the service. If you accept on behalf of an organization, you represent that you have authority to bind it. An authorized organization agreement takes precedence over conflicting provisions of these terms.

The service is intended for business users aged 18 or older. You must be authorized to access the facilities and records you use. An invitation or access to an account does not authorize access to another organization’s information.

2. Product scope and inspection responsibilities

Bluebird Compliance provides applicability-based inspection questions, documented findings, photo evidence, reports, and corrective-action tracking for supported published checklist releases. Available states, generator categories, waste modules, and versions are identified in the service. Draft or under-review material is not a published checklist release. A routine inspection is not necessarily a comprehensive regulatory audit.

The service is an inspection-support tool, not legal advice, an agency certification, or a guarantee that a facility complies with every applicable requirement. Results reflect the facts, conditions, responses, and evidence recorded by users. Laws, adopted editions, permit conditions, local requirements, and facility circumstances can change or introduce requirements outside a selected checklist’s scope.

You are responsible for supplying accurate information, choosing appropriate applicability facts, reviewing relevant requirements, completing inspections and required records, acting on findings, and meeting regulatory deadlines. An unanswered or unverified requirement is not a pass. Closing a corrective action does not change the original inspection response or establish that a regulator has accepted the resolution. Regulatory update notices are references; they do not automatically revise completed records.

3. Accounts and acceptable use

Protect your credentials and devices, use individual accounts, and promptly report suspected unauthorized access. Company administrators are responsible for authorized users and organization settings within their control. Do not bypass access controls, access other customers’ information, introduce malicious files, interfere with the service, or use it unlawfully. Do not upload payment-card numbers, government identification numbers, medical records, passwords, or other sensitive information unrelated to the inspection.

4. Customer information and records

You and your organization retain your rights in information you upload. You grant us permission to host, process, display, and transmit that information as needed to operate, support, and protect the service and as described in the Privacy Policy. You must have the rights and permissions needed to provide it. Our software, branding, and original platform materials remain ours or our licensors’ property.

Saved inspections can retain the checklist version used when created. The service may preserve original submitted records and separate corrections or amendment history. Maintain the independent copies and official records your organization needs. Offline drafts and photos can remain in browser storage after sign-out; protect the device and preserve unsynchronized work before clearing browser data or changing devices.

5. Fees, subscriptions, and cancellation

Visiting the website or accepting these terms does not by itself create a paid subscription. Prices, billing intervals, renewal terms, taxes, cancellation procedures, and refund terms must be disclosed at checkout or in an agreed order before you purchase. You authorize recurring charges only when you expressly agree to a recurring plan. We will not substitute undisclosed subscription terms for that agreement.

Contact TerraGuardEnvironmental@gmail.com for billing questions or cancellation assistance. Refunds and cancellation rights are governed by your disclosed purchase terms, any separate agreement, and applicable law. Payment providers’ terms may also apply to their services.

6. Availability, changes, and termination

We may update the service and its supported scope. We do not promise uninterrupted availability, a particular recovery time, or that every draft or photo will synchronize successfully. Features identified as previews or beta may change. We may restrict access reasonably necessary to address security, misuse, legal requirements, or a material breach of these terms. Where reasonably practicable, we will provide notice and an opportunity to address the issue.

You may stop using the service and request account closure through our contact email. Closing an account does not automatically remove copies held by your organization, other authorized recipients, or your browser. Data requests and retention are described in the Privacy Policy; any applicable contractual and legal duties continue to apply.

7. Warranty disclaimer

This provision does not eliminate an express commitment in a separate written agreement, excuse a materially inaccurate description of the service, or limit rights or obligations that applicable law does not allow us to exclude.

8. Limits on liability

These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, or liability that cannot lawfully be limited. Nothing in these terms waives nonwaivable privacy, consumer, or other statutory rights or relieves us of legal data-protection duties. Any separate signed agreement may establish different limits.

9. Governing law and resolving disputes

Florida law governs these terms, excluding conflict-of-law rules, except where applicable law requires otherwise. Unless a separate agreement or mandatory law provides otherwise, disputes may be brought in the state or federal courts with jurisdiction in Volusia County, Florida, and the parties consent to those courts. Contact us first so we can try to resolve an issue. These terms do not impose mandatory arbitration or a class-action waiver.

10. Changes and contact

Material changes will be identified by an updated version and notice in the service or through another reasonable channel. Where agreement to revised terms is required, we will seek it. Changes do not retroactively alter the terms applicable to an earlier dispute. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
